Beth Modica Sentenced To Two Years In Prison For Rape After Testimony From Her Own Children

Former prosecutor and mother of four, Beth Modica, has been sentenced to two years in prison for raping two teenage boys following testimony from three of her children. Her 16-year-old daughter, Danielle, told the court that her mother had changed from a loving parents to a wannabe-teenager who would attend parties with high schoolers, smoke pot and drink excessively. Her behavior escalated to the point where she was soon competing with her teen daughter for a high school boy, eventually having sex with him in their family home. The judge in the case did not hide his disgust for Modica’s behavior or lack of remorse in the courtroom:
The justice noted that in the presentencing report, Modica told investigators that others were to blame for her behavior.
“You just about threw everyone under the bus,” Bartlett said. “You blamed everyone but yourself.”
Bartlett noted that as an educated person, an attorney and an officer of the court, Modica knew that having sex with underage boys, as well as supplying teens with alcohol and marijuana, was both illegal and immoral.
“I can’t imagine what was going on in your mind - doing this in your home with your children present,” Bartlett said. “What you did with your daughter’s boyfriend was disgusting.”
Parents had every right to think that their children were safe in the Modica home, where one parent was a lawyer and the other a police officer, Bartlett said.
“Ms. Modica, you are every parent’s worst nightmare,” Bartlett told her.
What gets to us most though, after reading this report, is not so much Modica’s refusal to take full culpability for her actions, but the fact that she is described as having “had sex with” teen boys rather than “raping” teen boys. Minors are not legally able to consent to sex with an adult, sex without consent isn’t making love or intercourse or even, really, purely a sex act. It’s rape. And by maintaining a distance between rape and sex in this particular case, one insinuates that, on some level, these boys could conceivably consent to the sexual advances of an adult woman. They “wanted it,” on some level. Because boys will be boys? Because boys love sex? Because the idea of a cougar is sexually desirable? Whatever the reasoning behind the decision not to describe Modica’s actions, in every instance, as rape instead of sex, is damaging to victims of rape and sexual abuse. It hurts their cases, it hurts the public perception of those who are affected by rape.
So, to be clear. Beth Modica did not have sex with teenage boys. Beth Modica raped two boys. Full stop.

Boys can always consent to sex cuz its in their genes, and boys are not victim. These boys can claim that older woman as their conquest. You can’t conquer and be conquered. Its only rape when our daughter’s purity is taken at an age we deem too young.
And sometimes…. rape is boring.
Guanabee, do your shoulders hurt from carrying around such a swollen head? So, teenagers (who are are already having sex by the way) who consent to sex w/ other teenagers are raping each other? Do you not remember High School? Did you not have sex when you were underage? Was it rape then? The age of consent in some countries is around the age of these victims. So other places around the world do think that teenagers are able to make adult decisions. Do you think that Americas teenagers are incapable of deciding if they want to have sex or not, therefore it’s rape?
Children (and young adults *barf*) of the same age playing doctor ≠ rape.

@Alex: You failed to address the fact that the age of consent is lower in other countries. Are said countries corrupt? I’m not saying to go out and get some underage ass (which is wrong), I’m saying I wouldn’t call it rape. How much of your judgment is changed form 16 - 18? You wouldn’t call it rape because, frankly, your views concerning this issue is shaped by being part of the patriarchy and living in a patriarchal society. I realize this sounds unpalatable and I’m running the risk of being called a feminazi but, hey. Such is the case.
Judgment changes wildly from 16 to 18… and 18 to 21…. and 21 to 30. It also changes differently from person to person and depending on cultural norms, religious teachings, social mores, etc. This, judgement, is not what we’re discussing, Richard. You’re bringing up a tangentially-related argument for the sake of… I don’t even know. Playing Devil’s Advocate? Feeling like a big man on an internet comments thread? The issue at hand is “rape” versus “sex” in the context of language and between an adult and a minor.
I realize the definition of minor varies legally from country to country, or even state to state. Again, this is not the point. In some places, it’s perfectly legal to stone a rape victim for bringing shame on her family. Is it wrong? Is it right? Well, it doesn’t really seem productive, does it? It seems like it’s hurting people somewhat needlessly, no? What’s lawful and what’s harmful are not always mutually exclusive. It has nothing to do with corruption; it has to do with keeping the powerless down and disenfranchised.
But I do believe that a teen boy whether or not anyone, in her own personal opinion, deems him able to consent to sex with someone his own age is not the one who holds power in any sort of sexual relationship with an adult woman.
Furthermore, to say that Beth Modica had sex with these kids instead of raping them is doing, in the great scheme of things, a disservice to rape victims. To give the impression that a rape victim “wanted it” is not only to completely discredit the experience of having undergone a rape, it also enforces misogynist views on women and men and attempts to place blame on biology (Men can’t help it! They always want sex! Why would a dude NOT choose to have sex?) rather than on the fact that an incredibly serious act has been committed.
As for your swollen head and ass comments - What a wonderful way to bolster your argument. My respect for you has skyrocketed due to your disarming wit and charm.

So, first you accuse me of trying to be a “big man” on the net, then you say that I discredit myself by giving you a slight bash. Oh what should I do?? All I’m saying is that you’re giving a very direct black and white answer to something that’s obviously (especially according to your last post) a very gray area. One last thing, then we can lay it to rest: When an 18 y/o has sex w/ a 16 y/o, is it rape?
YES…if the age of consent is 18, then it is statutory rape for an 18 yr old to have sex w/ a 16 yr old…usually not enforced though…
An adult who has sex with a minor is breaking the law and IMO grossnasty…
