SensASIANal: Los Angeles Woman Lucie J. Kim Has Filed A Class Action Lawsuit Against Miley Cyrus

Los Angeles woman Lucie J. Kim has filed a massive $4 billion class action lawsuit against Miley Cyrus over her now infamous “Asian” pose.
In the suit, Kim says that each Asian Pacific Islander is entitled to the minimum damages for a civil rights violation, which amounts to $4,000 per person.
Kim also claims that Miley’s initial apology is not enough and that she should have known, when choosing to pose for the photo, that ”her image would be publicly disseminated via the media, which Cyrus knew focused on her private life, specifically TMZ.”
We wonder how - or even if - this lawsuit will hold in court. Mainly because we have our own long, long list of people we’d like to sue on the grounds that they “should have known” better / are idiotic. Also: Can one person decide to legally represent every member of a group? When did Asians vote on nominating Ms. Kim?

Actually, based on the June 4, 2009 hearing, and the comments made by Kim’s lawyer accusing the judge (who gave him a chance to keep this bullshit lawsuit going) of being a racist, it appears that Henry Lee has not only destroyed his own legal career, but also that he will be the one filing bankruptcy after Mylie goes after him for his wasteful lawsuit. Nobody other than Kim’s lawyer would know such details about the case. And, if Kim’s lawyer thinks Judge Sohigian will grant more than $500 in discovery sanctions, if any, obviously has not had a case in front of this judge before. If I were Kim’s lawyer, I would pay more attention to the next 128.7 sanctions motion rather than flooding the defense with thousands of discovery requests. Per the LASC Court register, Sohigian routinely and freely grants 128.7 sanctions for the full amount requested whereas Judge Hess does not. Probably would have been better for Kim and her lawyer to keep the “case” in front of Hess.
It is crystal clear that Lucie Kim’s lawyer is posting these comments. What is more troubling is that money is the only motivating factor behing the frivolous lawsuit. While Kim and her lawyer are proclaiming themselves as heroes on behalf of all Asians, their drive for money sullies their motive. I am not sure why the lawyer is authoring these comments as “Thomas M. Lee” instead of using his real name. The Plaintiff’s attorney is Henry M. Lee. Changing the first name but not the middle initial and last name does not provide much anonymity for him. Yeah, this really shows how smart this lawyer is. In fact, he is so smart that he is celebrating the “victory” of getting his bullshit case transferred to Judge Sohigian, a pro-defense judge who rarely certifies class action cases especially where the class Plaintiff is the employee of the class lawyer and where the class lawyer admitted during an interview with radaronline that the class claims are too individualized (”some may be offended, some may not”). I’m an Asian-American attorney living in Los Angeles. Two thoughts came to mind when I heard about this lawsuit. First, I’m appalled that this thing ever saw the light of day. Second, there are no legal grounds for alleging a civil rights violation.

The article asks how well this lawsuit will stand up in court. The answer: it’s going to be blown out of the water as a waste of everyone’s time. So says this Asian-American lawyer. Ms. Kim and her attorney are suing Ms. Cyrus under California’s Unruh Act, which forbids discrimination in relation to operating your business. For example, if Dennys refuses to serve Asian-Americans, you can sue Dennys under Unruh. But this is a private photo; there’s no business connection between the picture and Ms. Cyrus. So the Court will throw out the lawsuit on the ground that there was no legal violation. The lawyer who wrote up the complaint did a poor job.
It is obviously clear that the lawyer, and his secretary, Lucie Kim, filed the BS lawsuit in an attempt to garner FREE national advertising through the media Gloria Allred style. Now that their time in the limelight is over, they now need to worry about whether Ms. Cyrus will retaliate against them after she prevails. A malicious prosecution lawsuit against the lawyer and his secretary would teach them a good lesson that the legal system should not be used as a vehicle for cheesy advertising.

The problem here with the case is that when you boil it all down, all that remains is a mean spirited jealous Asian lady and a bully lawyer looking to gain notoriety, fame, and money by attacking a 16 year old girl who happens to be famous and got caught acting stupidly as most teenagers do. Mylie’s fame may have cast her in the public eye, but she never gave up her right to freedom of speech. True, it may be offensive for her to claim she has a right to make offensive gestures or comments, but it is her right to do so under the 1st amendment. What right does the public, much less a greedy Asian and her lawyer, have to control what Mylie does in her private life? I wonder how many of the above comments were reelly posted by Lucie Kim, her lawyers, and Cyrus’s lawyers. I doubt Al Gore envisioned such a waste of this internet he invented. Also what a waste of a law license! No wonder lawyers are regarded as the scum of the earth.
I think that Ms. Kim’s lawyer bit off more than he can chew with this lawsuit. No matter what, I agree that this scenario involves a hungry lawyer yearning for cheap, but quickly forgotten, fame by suing a young girl who happens to be a dumb immateur celibrity. We need to question the legitimacy of such an abuse of our legal system especiialy where the so-called plaintiff claims injury that is crystal clearly frivolous. I pray that our justice system will see to it that this lawyer and his so-called employee “client” suffer the consequences of there attempt to prostitute the legal system to profit themselves at the expense of a dumb/stupid teenager. Besides, who cares what Mylie Cyrus does with her eyes?!??!?!?! Why should Asian “Pacific Islanders” dictate and command that whites have no right to stretch their eye sockets with their fingers?!?!??!?!?! The A of USA does not stand for Asians! The beauty of our country is that everyone, including trailer trash celelbrity children of one hit wonder music artists, have the right to speak their mind no matter how offensive.

The comments posted by “Thomas” Lee is actually by Henry Lee, Kim’s lawyer. Really pathetic and lame that Kim’s lawyer could not think of a better way to hide his identity here. Even more pathetic is that Henry Lee stole the identity of his disabled younger brother, Thomas, to post the self-serving comments. A better name for Kim’s lawyer to use for himself would be “Coward M. Lee” if you ask me.
