Supreme Court Overturns “Racialist” Sotomayor Firefighter Decision

Sotomayor Explains It

The United States Supreme Court said AW, HAIL NO to Judge Sonia Sotomayor and her “racialist” colleagues on the US Court of Appeals of the 2nd Circuit today by overturning their decision that a fire department  in New Haven, Connecticut acted appropriately in denying promotions to a group of test takers who were not sufficiently diverse, (or black, if you will). The fire department, in fear of legal trouble, threw out test results when no black firefighters scored well enough to earn a promotion, thereby denying promotion to the group of firefighters who had passed the exam. The 2nd Circuit said that, in order to satisfy people of color quota laws, the fire department had to keep the white man down. The SCOTUS ruled that fear of litigation should not justify disparate hiring practices.

This ruling might have Sotomayor haters all eager to attack, but the Justices were not so critical of the 2nd Circuit’s opinion, noting that the case involves “a difficult inquiry.” Moreover, it’s not as if white-hating Sotomayor was the only judge presiding over the decision overturned today. Of course, our friends at Fox News and others similarly inclined will take this as an indication that if Sotomayor is appointed to the SCOTUS we’ll be inundated with rulings supporting affirmative action such that good ol’ whitey won’t be able to get a job no place, no how. But, more moreover, two of the firefighters denied promotions were dirty, brown Hispanic, which means that Sotomayor was being reverse reverse racist against her own people which means that HOLY SHIT - brain aneurysm!! It’s all confusing for a sec, until you realize that people who fail tests shouldn’t get promotions, but the laws governing employment are so confusing and every employer is so scared shitless of discrimination, that making errors will happen. Even for our dear abuelita.

    Maybe not errors but a conscious decision to not affect budgets at the expense of those who have merits for a promotion.

    • That’s not an error? Are you suggesting that employers should deny promotions to those who deserve it because otherwise they would need to budget for legal fees related to defending their decision?
