The Federal Government Has Sovereignty Over Our National Borders
Right from the start, this little exercise should have never happened because the state of Arizona simply has no jurisdiction. For some people who are so in love with The Constitution, they sure do pick and choose the parts they love. But, hey. The Republicans needed some kind of dog and pony show to trot out in front of voters to woo them back to their failed party, so, fine. You did your lap dance, but now you have to walk out into the club parking lot in the cold, light of day and face facts: Local and state government cannot create laws that presume to override federal laws already in place for such matters. There is precedence. Most recently, (and this is one of many cases thrown out by Supreme Courts all over the country), in the shithole of Farmers Branch, Texas--that's outside Dallas, y'all--the Texas Supreme Court struck down housing legislation created to prevent landlords from renting to illegals. Why? You can't legislate that shit, Jim Bob. Why? Because y'all's racist. That's why the federal government makes immigration a federal decision, so EVERYBODY not just you and Suzie Mae and the boys at the local, volunteer fire department get to weigh in. Because America has a little experience with those who purport to defend "state's rights." It's called the Civil War. And it was about racists who wanted to keep their slaves. (By the by, the Farmers Branch case was the city’s third attempt at passing an ordinance of that type. The experiement has cost residents about$3.2 million in legal fees to defend. Now that we have the clearly unconstitutional part down, let's deal with the little matter of how exactly an Arizona peace officer is going to decide whether someone they've LAWFULLY pulled over, (no one is going to just pull over more brown people than white people, of course), is probably an illegal alien. What are the criteria? Well, that greased pig has been thrown in the yard of the Arizona Peace Officers Standards and Training Board or AZ POST. Governor Brewer has made an executive order that they will figure out how to take this lame-brain idea and make it not seem racist. Even though the Patriot Act of 2001 gives the Attorney General the ability to detain foreigners without charges for an infinite amount of time, that power does not extend to the state of Arizona. Once again, because the AG has to prove that the suspect poses a national threat and the State of Arizona is not authorized to make such a charge, the best they can do is hand these folks over to the feds, which is the system that was already in place anyway. ReplyI'm no lawyer but I think that makes alot of sense. Scary but the 2010 Census did not seem fair to Hispanics then and now I can certainly see a racist agenda. To top this scary and racist shit off I still don't see Obama denouncing the census where it concerns Hispanics and race.

ReplyWhat is AZ supposed to do? School boards, county/state services losing milions. I am for legal immigration and AZ definitely has a large illegal population in the state. But, i don't know about this law. I would not want to drive in AZ in the summer. I think my tan would get me pulled over....

ReplyAZ was hit hard in the housing bubble. But I think it is more complex than your simplified answer. County and state programs for healthcare and education were going broke prior to housing collapse. And aren't we talking about "illegal" immigrants instead of just immigrants as the GOP scapegoats? Again, i don't think this law is just and there will probably be federal intervention.

Replyi'm against the bill on principal and agree that it's entirely unconstitutional. what i think is most stupid, however, is that it doesn't even make sense practically. the bill not only allows law enforcement to stop suspected undocumented immigrants, it also allows that same suzi mae and the boys at the local, volunteer fire department to SUE THEIR OWN GOVERNMENT if they believe the laws aren't being enforced. this, of course, is not-workable from the standpoint of (literally) centuries of case law on sovereign immunity. but even more simply, who the fuck thinks suzi and jimbob and bobjim WON'T sue the government on a weekly basis?! az is going to end up paying more to defend such suits than it does to enforce the damn law in the first place. and this is leaving out entirely the lawsuits by american citizens who are racially profiled and harassed. dumb fucks.
ReplyYou hit the nail in the head. This is a lose-lose law that will cost the state (and U.S. Citizens, since Arizona receives $1.19 from the federal government every tax dollar they pay) quite a bit of money in legal tie-ups.

SO SO sick of this argument against immigration. for once and for all: undocumented immigrants have a net positive effect on the economy. their employers pay payroll taxes for keeping them employed. the overwhelming majority of undocumented immigrants also pay income tax. immigrants as a whole UNDERutilize social services, including hospitals and welfare; undocumented immigrants underutilize such services to an even greater extent. amount of taxes > dollar amount of services use = american government profiting on the backs of undocumented immigrants, NOT "losing millions."

ReplyLet's be honest: calling this law racist is the only argument you have, and it's pretty lame. It's not unconstitutional. You just want to echo the very real contest against Obamacare, which IS unconstitutional. All Arizona did was extend its trespassing laws, so if you're here illegally, you're trespassing and will be removed. The state of Arizona has jurisdiction to protect itself, and when illegal invaders aren't stopped by the federal government, it falls to the people to take care of the problem themselves. Can a racist cop abuse this law to advance a racist agenda? Yes. But that's a problem with the person enforcing the law, not the law itself. And has anyone considered how many cops in Arizona are Hispanic? You who protest this law are not afraid of racial profiling. You're afraid of the law being enforced and illegals expunged from this country. It's like a burglar protesting me putting a new alarm system on my house so he can't rob me anymore.
